Dismissal due to illness: UWV and rights
Questioner
My employer has filed for dismissal at UWV for business economic reasons. I was immediately suspended on 30 May 2012. I filed a defense via the union but to no avail and dismissal was granted. What is strange is that the so-called department is being closed down, my other colleague was also dismissed but still works there via her ZZPer company and is therefore being hired. I myself have been ill since the end of February 2012 with thrombosis in the leg and pulmonary embolism. It was also strange that they had made a plan of action in April that I would be 100% by June and I was being chased quite a bit with everything. Unfortunately I am still ill so they cannot grant the dismissal. But what now. Of course they are going to try again. And the figures, well according to the union they were not complete but the UWV says that it is all correct.Lawyer
If you are still ill at the time when the period within which the dismissal permit can be used has expired, the employer cannot legally dismiss you. A new dismissal permit must then be requested or dissolution via the subdistrict court. However, if a dismissal permit has already been granted that could not be used due to illness, in practice it appears that the UWV almost always issues a new dismissal permit. However, if you now have new information, such as hiring a self-employed person, you may submit all of that and perhaps the UWV will then make a different decision.Neem de volgende stap
