Legal questions about employment contracts

Questioner

If you have a 4-hour contract and you have worked an average of 30 hours in the past months, can the employer oblige you to stay home for the coming months and pay for those extra hours spread over those months?

Lawyer

Hello, The law states the following about this: 'If an employment contract has lasted for at least three months, the agreed work in any month is presumed to have a scope equal to the average scope of work per month in the three preceding months.' In other words, if you have worked at least 30 hours for three months, a legal presumption of employment arises and you can claim to have worked those hours and to be paid for those hours.
