Bought a car for eur 2400. After a day the engine was broken, car became worthless. Advertiser was no longer reachable by phone. Also at the address where the transaction took place, I did not find the seller anymore (empty house) Now on zeelandnet / prikbord (kind of regional marketplace) found a similar advertisement for a car. (photos are clearly taken for the same house) Sale now takes place in a nearby village. Phone number has changed. Is there a way to recover the damages suffered and stop this alleged scammer?Lawyer
If you bought a car from a dealer, it is assumed that the car was already defective upon delivery. If you did not buy from a dealer, you must demonstrate that there is a hidden defect and that you have not violated your duty to investigate. You can then try to get your damages compensated through the court and/or terminate the agreement with return of the car and repayment of the purchase price. This can take up to a year. Given your story, I fear that you are dealing with a 'bare chicken' and I wonder whether it makes sense to file a claim with the court. If you have legal expenses insurance, I advise you to at least bring the case before your insurer.
