Liability for Non-Compliance with Contracts

If you enter into a contract to receive services from xxxx on June 28, and they only arranged everything on July 10, 12 days later, due to stupid mistakes, including a cable that was not connected to the general exchange but was loose, plus despite the fact that a technician had been there, a new HD recorder arrived, it still did not work, this had activated the smart card and I myself had not yet converted it in their system, so that was one of the reasons why no channels were received... so just stupid mistakes... as a result of which the internet was down for 10 days and TV for 12 days. can xxx then be held liable for the backlog incurred by the foundation due to the lack of services? because they think they are not liable for that. but I think they are, and I said that I think it is only fair that for the frustration and the time it cost plus at least 40 hours less on the internet .... that they can reimburse 2 months of subscription costs to cover the damage. and they offer a paltry amount of 20 euros, after all the misery. so I wonder to what extent your internet company can be held liable for not delivering services at the agreed time. contract is private, foundation is registered at this addressLawyer
The usual course of events in the event of non-compliance with an agreement is regulated in Book 6 of the Dutch Civil Code (Article 74 et seq.) The first step is a written notice of default and giving a reasonable period (2 to 3 weeks) to still comply. Only then does default occur and is the other party liable for damages. You have not followed this procedure and I therefore see no grounds for compensation in this case. In addition, you will also have to prove the damage and it will have to be financial damage (i.e. money).
