Legal Advice on Dismissal: What are Your Obligations?

Questioner

Dear, I have a 4-hour contract and yesterday I quit my job. For the coming weeks I was scheduled for an average of 38 hours, but I would prefer to work only those 4 hours. My boss says that he can rely on my average working hours of the past 3 months, and that I am obliged to work this average. Now I wonder what my obligations really are and how many hours I have to work at least. Thanks in advance!

Although I have only encountered employees who invoke it so far, your employer is right. There is a so-called legal presumption of a working time of 38 hours in your case. So formally your employer is right. Article 7:610b BW If an employment contract has lasted for at least three months, the agreed work in any month is presumed to have a scope equal to the average scope of work per month in the three preceding months.
