Liability and compensation for car damage

Questioner

After having new tires fitted by a company, we lost our left front wheel on the highway after driving 800km! When checking, it turned out that the other front wheel had 2 loose bolts out of 5. Our car is fully comprehensive insured, but as it looks now, the car will be declared a total loss and we will get the current value, for which we (probably) cannot buy back a similar car. Can we hold the company liable and claim compensation, so that we can buy back an equivalent car? Fortunately no personal injuries

Lawyer

That will be very difficult. The current value is the value that the car has in economic traffic at the time of the accident. That is also the maximum damage that you normally get compensated for.
