Dear Sir/Madam, On April 17, we received a signed quote and made a 30% down payment through a solar panel company on the internet. Due to circumstances that unfortunately occurred today, we would like to ask you if it is still possible to cancel the order and get the deposit back?Lawyer
Day, The starting point is purchase = purchase. You probably signed a combined contract/quotation for the purchase of the panels and the processing of that material. A construction contract. You must correct me if that is not the case because then other rules may apply. Also relevant is how you came to sign the quote, completely remotely? (by telephone / online) if the latter is the case then you must immediately cancel the purchase, you still have time for that.Questioner
I have given a signed agreement to the quotation and sent it to the company as a file. On this offer, when you sign you agree to the general terms and conditions, but I cannot find anything about cancellation on these terms. However, I have already made a down payment.Lawyer
Day, I advise you to cancel your purchase today and claim your money back, see article from Book 7 of the Distance Selling Act: Article 46d 1. The buyer has the right to cancel the distance purchase without giving reasons for seven working days after receipt of the item. If not all the requirements set out in Article 46c paragraph 2 have been met, this period is three months. The first sentence applies accordingly from the moment all the requirements set out in Article 46c paragraph 2 have been met within the period referred to in the second sentence.Neem de volgende stap
