Are your working conditions fair?
Questioner
Dear Sir/Madam, I work in a small-scale care company, which was founded in 2010. My employers have outsourced their payroll administration etc. to a (well-known) payroll company. They have also indicated that we (employees) do not have a contract with them (employers), but only with the payroll company. We all have a zero-hours contract. We received a collective labor agreement for flex workers from the payroll company. It does not contain any rules about working hours, holidays, etc. There is also no irregular hours allowance applied for working on weekends. We are now also expected to work on holidays such as King's Day and Easter Sunday. We are not compensated for this with extra allowance or hours or the like. This seems unfair to me. I have always worked on holidays with previous employers in healthcare, but was generously compensated for this. Is this allowed? Thank you for your response and kind regards, L.Lawyer
If you are indeed employed by the payroll company, the employment conditions/collective labour agreement of that company apply. Who is listed as the employer on your employment contract?Questioner
Thanks for your quick response. The payroll company is my employer and I know that the payroll company's collective labor agreement applies, but it doesn't say anything about holidays.Lawyer
In that case there is no additional compensation/surcharge because this is not regulated by law.Neem de volgende stap
