Legal rights in case of secondment - Legal advice centre

Questioner

Dear, I have been employed by a temporary employment agency for two years now. But I strongly suspect that my temporary employment agency is underpaying me. Now I recently read in a newspaper article that temporary workers are entitled to the same salary as permanent employees after 26 weeks. My question is: Do I have these rights as a secondment agency, even if the agency in question does not have a collective labor agreement (ABU-NBBU collective labor agreement)?

Lawyer

Secondment cannot be compared to working as a temporary worker and there is no collective labor agreement. And then who are you perhaps being underpaid by? By other seconded workers or by the permanent employees of the company where you are seconded? And could that also be due to age, experience, etc., or is there perhaps discrimination? In short, it is not possible to give a good answer without more information.
