Questioner

On April 27th we got married, in advance we discussed the day several times with an employee of our wedding location, he promised many beautiful things where afterwards we still have 10 serious points that were very disappointing and were not acted upon according to our agreements. in advance we paid 2300eu now we still have to pay 2800eu. we have filed our complaints with them and now they come back with a letter in which they give their sincere apologies on all 10 points and admit that they were wrong and want to make it up with a high tea for 4 people in their restaurant. We think that they should tinker with the financial picture. Can we say that instead of the €2800 we only want to pay €1500,-?

In legal terms, your wedding venue has apparently failed to comply with the agreements made (Article 6:74 of the Dutch Civil Code). You are then entitled to compensation for the resulting damage. If this damage cannot be specifically determined (as is apparently the case with you), it must be estimated (Article 6:97 of the Dutch Civil Code). It is precisely in the estimation of the damage suffered that the shoe apparently pinches. Incidentally, it is clear from established case law that in these types of situations, compensation for pain and suffering is usually only awarded to a very limited extent (a maximum of a few hundred euros). I can imagine that offering high tea does not sufficiently meet your feelings of dissatisfaction. You can first try to reach an amicable agreement somewhere in the middle. In the worst case, you can proceed to pay part of the outstanding invoice and wait to see whether the wedding venue dares to send a collection order for the remainder.
