Statutory VAT increase when purchasing a kitchen: Advice

Questioner

In January 2012 we bought a kitchen. Agreement signed, price including VAT! The kitchen was supposed to be installed mid-November. Now we receive a message that as of October 1st (legally) the VAT will be increased, which means that we suddenly have to pay 250 euros above the agreed amount (which is stated including VAT). If we want to cancel the order, we have to pay 10% of the costs of the kitchen. Do we have to pay that VAT increase or only the agreed amount for which we signed, which is already stated including VAT on our purchase agreement?

This depends on what exactly has been agreed in the contract and what is stated in the general terms and conditions if they apply. The general terms and conditions often state that in the event of a VAT increase, this may be passed on to the customer.
