Questioner

I have a fixed-term contract of 32 hours from 1 August 2011 to 1 August 2012 through my employer. As of 1 January, my contract has been extended by 8 hours through an Amendment to Employment Conditions. This extension applies until 1 January 2013. My boss is now on holiday and it looks like I won't hear anything before 1 August. To what extent does tacit extension apply then?

The answer to your question is given in Article 7:668, paragraph 1 of the Dutch Civil Code: 'If the employment contract is continued by the parties without objection after the expiry of the period (...), it is deemed to have been entered into again for the same period, but each time for a maximum of one year, on the previous conditions.' In other words, you can assume on the basis of the law that the change to your employment conditions as of 1 January has been maintained due to the tacit extension.
