How is a person's residential address determined? Article 1 of the GBA Act stipulates that a residential address is defined as: the address where the person concerned lives. To determine where someone lives, 'sleeping place' is not the only criterion. It involves a number of criteria (night's rest, meals, receiving mail, receiving visitors, etc.). Only if someone has multiple addresses or does not have a residential address, the number of overnight stays is decisive. If someone lives at multiple addresses, the address where he or she is expected to spend the most nights during a six-month period applies. If it is not yet possible to determine where someone lives on the basis of the above (for example because he or she does not 'live' anywhere), the address where the person concerned is expected to spend the night for at least two-thirds of the time during a three-month period applies. This is possible, but the RULES of the GBA determine what your residential address is.
