Employer liability in case of telephone theft

Questioner

At work, my private iPhone was stolen from my bag next to my desk during lunch. At that time, I did not have a locker (we had only been at the location for 1.5 weeks). I reported it to the police and held my work liable. My employer has indicated that their inventory insurance has a deductible of 2500 euros and therefore unfortunately cannot do anything for me. Is there another way I can try to recover the costs for a new phone from my employer?

It is not relevant whether your employer has a deductible. He is liable for the damage you suffered during working hours as a result of theft unless, for example, those lockers were already there (one of the employer's measures to prevent theft) and you had not made use of them. I do not know who informed you at work, but I advise you to send a registered letter with a copy of the report to the HR department or otherwise the financial administration (often someone works there who manages the insurance portfolio). It would be nice if you could ignore the damage that is not covered by your insurance as a result of a deductible in this way.
