Freedom in warranty: your rights when purchasing furniture

Questioner

Last year we bought a sofa for 1100,- (1500,- if you also include the pouf). It had a one-year warranty. Just outside the year (+/- 14 months) the sofa sagged, this is getting worse. We approached the seller, initially they did not want to do anything because the year was over and it was therefore outside the warranty. After a new attempt on our part they wanted to repair the sofa for 200,-. Now I am of the opinion that they should do this free of charge, even though it is outside the warranty period, because you can expect a sofa of 1100,- to last a number of years with normal use. Can I demand that they do this for free? Or should I be satisfied with paying 200,-? And if I am in the right and they refuse to repair/replace it free of charge, can I then either terminate the agreement or reclaim (part of) the purchase price?

You can indeed expect a sofa to last longer than a year, you can indeed demand this in my opinion. I would like to assist you in this matter.

You are not bound by the warranty period offered by the seller. Even after that, you may expect that the sofa will not simply collapse within a reasonable period of use. To that extent, you may demand that it be repaired free of charge or for a small amount. You may perhaps adjust and send this letter: http://www.rechtswinkel.nl/documenten/7/ingebrekestelling.html
