Liability for damage to commercial vehicles

Questioner

In a company car and during working hours I have caused damage to another car and to the company car. My employer is not fully comprehensively insured and wants to recover the damage to his own car from me. My contract contains an article about having caused unnecessary damage that I am personally liable. To what extent is this article legally valid?

Lawyer

The employer cannot recover damages from the employee unless there is intent or conscious recklessness. Making a traffic error that causes damage is not sufficient for this. In practice, the employer can almost never recover damages caused by the employee from the employee.
