Legal assistance with mortgage obligations after divorce
Questioner
After the relationship ended, I left our owner-occupied home and agreed that as long as the situation did not change (my ex-partner would live alone in the house), I would continue to pay my share of the mortgage premium. The house has now been put up for sale. However, my ex-partner has a new relationship and now lives together in the owner-occupied home, the situation has changed in my opinion. I have proposed to no longer pay the mortgage premium, since my ex-partner now lives together. I have no usufruct of the home and of course I have to pay my own costs. (I also paid the costs related to the move, deposit etc. myself, my ex-partner does not contribute to my rent or the like) Unfortunately, my ex-partner does not want to agree to my proposal and demands that I continue to pay. What are my obligations in this? and what is reasonable? Thank you in advance for your time and attentionLawyer
The answer is that agreements on alimony and division of property can be made through the court and that these agreements can be adjusted if the situation changes. In this respect, living together with a new partner (as if one were married) is very important. From that moment on, there is no longer any right to spousal support. The continued payment of the mortgage premium is often (partly) disguised spousal support. My office has handled these types of cases before. The content is not very exciting.Neem de volgende stap
